Pacibook Terms

These Terms and Conditions (the “Terms”) form a legally binding agreement between you (“you” or “User”) and Innovativus Technologies Private Limited (operating the Pacibook brand) (“Pacibook”, “we”, “us”, or “our”).

If you do not agree to these Terms, do not access or use the Services. If you are using the Services on behalf of an organization (including an institution), you represent that you have authority to bind that organization to these Terms.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws. Where required by law, certain disclaimers and limitations may not apply.

“Services” means Pacibook’s website, applications, reader, offline features, AI translation features, and related services we provide.

“Content” means all materials available through the Services, including eBooks, text, images, metadata, and software.

“Digital Content” means eBooks and any other downloadable or streamable digital items offered through Pacibook.

“AI Features” means translation, summarization, or language tools powered by automated systems.

You must be at least 18 years old to create an account. If you are under 18, a parent or legal guardian must create and manage the account and is responsible for your use of the Services.

• You must provide accurate, complete, and up-to-date information.
• You are responsible for safeguarding your login credentials and device access.
• You must notify us promptly of any unauthorized access or suspected security breach.
• We may suspend or restrict accounts to protect users, comply with law, or enforce these Terms.

Accounts issued by institutions (e.g., students) may be subject to additional rules communicated by the institution and/or by Pacibook, including access duration and content availability.

Pacibook provides an online eBook store and reading experience, including optional AI translation and offline downloads where supported. Features may vary by device, location, plan, and content rights.

We may add, remove, or change features and Content over time. We do not guarantee that any specific Digital Content or feature will always be available.

Access to certain Content may be restricted or removed due to licensing or legal requirements. Where required by law or where we determine it appropriate, we may offer a refund, replacement, or credit for affected purchases.

When you purchase or access Digital Content, you receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use that Digital Content for your personal, non-commercial use through the Services.

• You may not resell, rent, lease, share, distribute, or publicly perform Digital Content.
• You may not copy, extract, record, scrape, or reproduce Digital Content except as permitted by law.
• You may not remove, obscure, or alter any copyright, watermark, DRM, or security feature.
• You may not attempt to bypass access controls, device limits, or usage restrictions.

Offline downloads (where available) are provided for convenience and may require periodic verification, updates, or re-authentication. Offline access may be limited by device, storage, plan, or licensing constraints.

Prices are displayed at the time of purchase and may change. Taxes, levies, or other charges may apply depending on your location and applicable law.

Payments are processed by third-party payment processors. We do not store your full payment card details. Your payment may be subject to the processor’s terms and privacy practices.

You authorize us (and our payment processors) to charge your selected payment method for purchases you make. You agree to keep your payment and contact details accurate and up to date.

We may refuse, cancel, or limit transactions to prevent fraud, comply with law, or enforce these Terms.

Because Digital Content is delivered electronically, refunds are limited and are provided only as required by applicable law or as described in our policies.

Our current refund and replacement rules (including eligible scenarios and timelines) are described in our Privacy Policy under “Refund and Replacement Policy”. In case of conflict, the more specific refund policy section will apply to refund-related questions.

AI Features are provided to assist comprehension. They may generate inaccurate, incomplete, or inappropriate output. Do not rely on AI output as professional advice (including legal, medical, or financial advice).

AI translation is optional and provided as a reading layer. The original book text remains unchanged.

You are responsible for how you use AI output. You agree not to use AI Features to generate or distribute unlawful, infringing, harmful, or misleading content.

You agree not to misuse the Services. This includes, but is not limited to:

• Violating any law, regulation, or third-party rights.
• Attempting unauthorized access to accounts, systems, APIs, or data.
• Using bots, scrapers, or automated tools to extract Content or overwhelm the Services.
• Uploading or transmitting malware, spyware, or other harmful code.
• Harassing, threatening, or impersonating others.
• Circumventing DRM, paywalls, or access controls.

We may investigate and take action (including suspension, termination, and legal action) for violations.

The Services (including software, design, and branding) are owned by Pacibook and/or its licensors and are protected by intellectual property laws. Digital Content is owned by the respective rights holders and licensed to you as described in these Terms.

You may not use our trademarks, logos, or branding without our prior written consent.

If you provide feedback or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction.

The Services may integrate with third-party services (e.g., payment processors, analytics, login providers, storage providers). Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services we do not control.

Links to third-party websites are provided for convenience only and do not constitute endorsement.

To the maximum extent permitted by applicable law, the Services and all Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any AI output will be accurate or suitable for your needs.

To the maximum extent permitted by applicable law, Pacibook will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses arising from or related to your use of the Services.

To the maximum extent permitted by applicable law, Pacibook’s total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to Pacibook for the specific Digital Content or Service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to liability.

You agree to indemnify, defend, and hold harmless Pacibook, its directors, officers, employees, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Services.
• Your violation of these Terms or applicable law.
• Your infringement of any third-party rights, including intellectual property rights.

We may suspend or terminate your access to the Services immediately, with or without notice, if we believe you have violated these Terms, engaged in fraud, or created risk or possible legal exposure to Pacibook or others.

Upon termination, your license to use the Services ends. Certain provisions will survive termination, including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution.

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. If changes are material, we may provide additional notice (such as by email or an in-app notice) where required by law.

Continued use of the Services after the updated Terms become effective constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of India, without regard to conflict of law rules.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services will be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be New Delhi, India. The arbitration will be conducted in English by a sole arbitrator appointed mutually by the parties. Either party may seek interim or injunctive relief from courts in New Delhi to protect its rights pending arbitration.

Subject to the arbitration clause above, the courts at New Delhi, Delhi, India will have exclusive jurisdiction for any matters not capable of arbitration.

• Severability: If any provision is held unenforceable, the remaining provisions will remain in effect.
• No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
• Entire agreement: These Terms, together with our Privacy Policy and any additional terms presented at purchase or within a feature, constitute the entire agreement between you and Pacibook regarding the Services.
